Betar Lawyers ~ Friends of Ghana ~ Wills and Estate Planning Package

Apply for a simple Will & Last Testament

A will is cheaper than you may think.
Everyone must have a properly prepared Will for their Australian assets.

Everyone has assets

Even though customary laws and procedure may be activated in Ghana, if you are living in Australia the laws of Australia apply to any assets you have here.  It is very important that this is in place.

Over your lifetime you will earn money, increase your superannuation, own a car, own a house, have children, get married, get divorced, inherit money.  Why not decide for yourself how you want your estate to be looked after.  Without a Will this may not happen.

Look after your family

A will lets decide who should take care of your children, letting you make the best decision for your family.

Having a will allows you to do this and let your children be raised the way you want.

Having no Will can be expensive.

All estates must go through an 'official' process called 'probate'.  This lets your Will be "confirmed" and lets the choices you make be carried out.  Having a Will speeds up the probate process and informs the court how you’d like your estate divided.  Probate courts serve the purpose of “administering your estate”, and when you die without a will (known as dying “intestate”), the government will decide how to carve up your estate without your input and without considering your wishes.

You appoint each other your executor and beneficiary.  If you have children, you can leave your estate to them and request the optional testamentary trust.

This lets someone do things on your behalf if, for example, you are in a coma.  Things like paying bills can be done by this person from your accounts.

Enduring Guardianship

This lets someone make "lifestyle" decisions on your behalf.  If you are in a coma, then this person can speak to doctors for you.

Frequently asked questions?

Q.  What is a Will?

A.  A will is a legally-binding document that lets decide how your estate is to be handled.  Without a Will this may not happen!

Q.  How does this work?

A.  Once Betar Lawyers receives your Instructions Form, they will carefully read it, prepare your Will, process your credit card payment and contact you to arrange for you to come to their office and sign your Will.

Q.  What is a testamentary trust?

A.  This is an extra part of a Will that enables your children to benefit.  While they are children they are not able to have control of the gift you give them so an adult person will have the care and custody of this for them, and be able to look after them until they are adults.

Q.  I live outside of Sydney and its hard for me to get to your office.  Is there another way?

A.  Yes, we regularly send clients their Wills with an easy guide on how to sign their Will.  These are easy to follow steps on what to do.

Q.  Do you use email to communicate with me?

A.  Yes, we prefer email.  However, if you wish to call the office you are welcome to do so.

Q.   I don't have a credit card, can I pay any other way?

A.   Yes, you can pay by depositing your payment directly to the firm's bank account.  Details will be provided upon request.
